Welcome to DigiMotion AI, an AI-powered platform for creating UGC-style video advertisements at scale. These Terms and Conditions govern your access to and use of our services, platform, and all related features. By creating an account, accessing our website, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these terms. If you disagree with any part of these terms, you must discontinue use of our services immediately.
Service Description
DigiMotion provides AI-powered video ad creation services including brand research, script generation, AI actor casting, video production, creative review, and video delivery. Our services are offered through video pack purchases, where each pack includes a defined number of finished video credits. We continually enhance our platform with new features, templates, and AI capabilities, and these terms apply to all current and future services we offer.
Video Packs and Credits
DigiMotion operates on a credit-based system. When you purchase a video pack, you receive a specified number of video credits. Each credit represents one finished, client-approved video ad. Credits are consumed only when you approve a delivered video. Your purchase includes AI-generated scripts (with the ability to review and edit), AI actor generation (with revision passes), video production, and edit revision passes on the final video. The specific number of revision passes and inclusions may vary by pack and are communicated during the onboarding process.
Account Registration
To use DigiMotion's services, an account must be created through our sales-led onboarding process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must promptly notify us of any unauthorized use of your account or any security breaches. You may not share your account credentials with unauthorized individuals or use multiple accounts to circumvent service limitations.
Acceptable Use
You agree to use DigiMotion's services only for lawful purposes and in accordance with these terms and our Privacy Policy. You may not use our services to create content that is illegal, harmful, threatening, abusive, defamatory, misleading, or violates the rights of others. You may not use our platform to create content that infringes on trademarks, copyrights, or intellectual property rights of third parties. You are prohibited from attempting to gain unauthorized access to our systems, reverse engineer our technology, or interfere with the proper functioning of our platform.
Content Ownership and Licensing
You retain ownership of all brand assets, product images, logos, and brand guidelines you provide to DigiMotion. The AI-generated video content (scripts, actor images, produced videos) created for your account is licensed to you for commercial use upon approval and credit deduction. You may use approved videos across any advertising platform, social media channel, or marketing material without restriction.
DigiMotion retains the right to use anonymized production data and aggregate statistics to improve our AI models and platform capabilities. We will not use your specific brand content, logos, or produced videos for any purpose outside of delivering your services without your explicit written consent.
AI-Generated Content Disclaimer
DigiMotion uses artificial intelligence to generate scripts, character imagery, voice synthesis, and video content. While we strive for high quality and brand accuracy, AI-generated content may occasionally produce unexpected results. Our multi-step review process (script review, actor approval, video revision passes) is designed to give you full creative control before any credit is consumed. DigiMotion does not guarantee that AI-generated content will be free from errors or perfectly match your creative vision on the first generation.
Payment Terms
Video packs are invoiced through our payment processor. Payment terms, including due dates and accepted methods, are specified on each invoice. Credits are provisioned upon confirmed payment. Unpaid invoices may result in suspension of production services. All prices are in US dollars unless otherwise specified.
Refund Policy
Because DigiMotion provides a review and approval process at every stage (scripts, actors, edits), credits are only consumed when you explicitly approve a finished video. We do not offer refunds for approved and delivered videos. If you are unsatisfied with a video prior to approval, you may use your included revision passes or reject it without consuming a credit. Refund requests for unused credits on cancelled accounts will be handled on a case-by-case basis.
Service Availability
While we strive to provide reliable and uninterrupted service, DigiMotion is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that our services will be error-free, continuously available, or that production timelines will always be met. Production timelines may vary depending on video complexity, AI model availability, and queue volume. To the maximum extent permitted by law, DigiMotion shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services. Our total liability to you for any claims shall not exceed the amount you paid us in the twelve months preceding the claim.
Account Termination
You may request account termination at any time by contacting our team. We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or use our services in a manner that could harm other users or our platform. Upon termination, your access to our services will cease. We will retain your produced content for 90 days following termination to allow for download, after which it may be permanently deleted.
Modifications to Terms
We may modify these Terms and Conditions from time to time to reflect changes in our services, business practices, or legal requirements. When we make material changes, we will notify you via email at least thirty days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the modified terms.
Governing Law
These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services will be resolved through good-faith negotiation, and if necessary, binding arbitration. You and DigiMotion agree to waive any right to participate in class action lawsuits. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
